1. Scope
These Voice Notes Terms supplement the terms governing Clarity and the Apple Standard EULA. Mandatory consumer rights prevail in the event of a conflict.
3. Scope of service
Voice Notes provides local recording and transcription and, after separate selection, AI structuring, questions, exports, automations and sharing. Availability, accuracy, languages and providers may change with app, system or provider versions. Features labelled beta are not intended for critical workflows.
4. Review before use
You must review transcripts, speaker assignments, summaries, tasks, events, reminders and messages before use. A preview or AI recommendation does not confirm that the content, recipient, deadline or legal position is correct. Actions with external effects are carried out only after your confirmation.
5. Prohibited use
Prohibited uses include covert or otherwise unlawful surveillance, impermissible biometric identification, deception, harassment, infringement of personality, copyright or privacy rights, circumvention of technical safeguards, and use for solely automated consequential decisions about other people.
6. Your content
You retain your rights in content that you lawfully provide. You grant Audecius only the rights technically necessary to provide the features you select. This does not permit use for advertising or the sale of your recordings. Third-party rights and legal duties remain unaffected.
7. Availability and security
Features may be limited because of maintenance, device restrictions, permissions, network or provider disruption, and security measures. Audecius may block processing or change features where this is necessary and reasonable to prevent abuse, protect data or comply with law.
8. Liability
Audecius has unlimited liability for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and to the extent of express guarantees. For a slightly negligent breach of material contractual obligations, liability is limited to foreseeable loss typical for the agreement; otherwise, liability for slight negligence is excluded to the extent permitted by law. Mandatory consumer rights and responsibility for AI or privacy errors that cannot legally be excluded remain unaffected.
9. Governing law and dispute resolution
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of their habitual residence. Statutory places of jurisdiction apply. Audecius UG (haftungsbeschränkt) is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.
