1. Mandatory local law
These terms adapt the agreement to the mandatory law of your habitual residence and do not reduce your rights. If there is a conflict, the local rule applies. A globally worded agreement does not replace country-specific product approval; Audecius restricts distribution until legal, technical and organisational requirements are met.
2. EEA, Germany, Switzerland and the United Kingdom
The GDPR or UK GDPR, Swiss data-protection law, digital-contract and consumer rights, and Germany's DDG/TDDDG apply where relevant. Consent is separate and revocable; transfers require safeguards. German consumers retain rights concerning defects, updates, withdrawal and courts. Accessibility, platform, youth-protection and dispute-resolution duties are assessed specifically.
3. United States
Applicable federal and state privacy, child, health, biometric, renewal and consumer rights apply. Clarity does not sell personal or consumer-health data and does not use it for cross-context behavioural advertising. Children under 13 are excluded without COPPA-compliant verifiable consent. State rights may include knowing, access, correction, deletion, portability, opting out and limiting sensitive data. Disputes are subject to the highlighted arbitration clause only to the extent it is effective.
4. Canada
Audecius observes PIPEDA and applicable provincial law, provides understandable, purpose-specific consent and enables access, correction and complaints. Sensitive data, minors and new purposes require an express choice appropriate to the risk; cross-border processing is made transparent.
5. Brazil
Under the LGPD, data subjects may receive confirmation, access, correction, anonymisation or deletion, portability, information about sharing and review of automated decisions, where applicable. Data about children and adolescents follows their best interests. International transfers require an ANPD-compliant basis.
6. Australia and New Zealand
Applicable Privacy Principles, data-breach, consumer and minor rights remain unaffected. Audecius identifies purposes, recipients and overseas processing and offers access, correction and complaints. Duties concerning age, online safety and health data are assessed separately before distribution.
7. Other countries
You retain non-waivable privacy, consumer, contract, child, health, content and court rights. Where local registration, representation, data localisation, age verification, consent or authority access cannot be fulfilled, Audecius must not offer the storefront or affected features.
